SCOTUS overturns 5th Circuit ruling that told ISP to kick pirates off Internet

The Supreme Court vacated a 5th Circuit decision that could have forced Grande to cut off broadband subscribers accused of piracy.

The Court sent the Grande case back to the Fifth Circuit for further consideration in light of its recent Cox v. Sony ruling.

In October 2024 a unanimous (3-0) Fifth Circuit had found Grande liable for contributory copyright infringement and a $46.8M verdict was entered.

Last month the Supreme Court also rejected a 4th Circuit ruling against Cox, establishing the Court's approach to ISP liability.

Record labels have pursued financial claims against ISPs; Cox had a $1B jury verdict overturned, and the 5th Circuit ordered a new damages trial for Grande.
