Musk updates OpenAI lawsuit to redirect potential $150B in damages to the nonprofit foundation

Musk updated his lawsuit to redirect any damages—potentially more than $150 billion—to OpenAI's nonprofit foundation instead of to him.

His lawyer, Marc Toberoff, says Musk is not seeking a single dollar for himself.

Musk also seeks removal of Sam Altman from the foundation board and asks Altman and Greg Brockman to turn over their shares and financial benefits to the foundation.

He accuses OpenAI of abandoning its charitable mission and of defrauding him by exploiting its nonprofit status.

Trial is scheduled to begin in April in Oakland, California; OpenAI called the filing on X a harassment campaign and has asked the Delaware and California attorneys general to investigate Musk; OpenAI is valued at $852 billion and is planning an IPO.
