Google asks to dismiss pending copyright infringement lawsuit, citing the Cox ruling

Google has asked a federal judge to dismiss the last remaining copyright claim in a textbook piracy lawsuit.

The company argues the Supreme Court’s Cox ruling requires proof that it intentionally induced infringement, which publishers cannot establish.

Google says the case’s secondary-liability theory is now legally invalid under the Court’s narrower standard.

The motion could help shape other piracy and ISP liability cases, where defendants are seeking dismissal under the same precedent.
